Abstract

This study examines the legal consequences of listing an adoptive father’s identity in a child’s population administration records and analyzes the issue from the perspective of maqasid al-Syari‘ah. This research employs a normative legal method using statutory and conceptual approaches, with legal materials analyzed qualitatively and prescriptively. The findings show that listing an adoptive father’s identity does not automatically alter the child’s lineage (nasab), since adoption creates a legal relationship of care without replacing the genealogical relationship with the biological parents. However, administrative records that fail to distinguish between biological identity and legal caregiving identity may give rise to administrative and evidentiary consequences and create risks of error in determining marriage guardianship, mahram relationships, inheritance, and the child’s right to know his or her origins. From the perspective of maqasid al-Syari‘ah, the protection of lineage through hifz al-nasl must be harmonized with hifz al-nafs and hifz al-mal. This study proposes a differentiated legal identity model that emphasizes the preservation of genealogical identity, identity differentiation, and administrative protection through the principles of non-substitution, legal recognition, and traceability.
